Woodbury Vineyards & Winery ("Woodbury," "we," "us," or "our") operates woodburywinery.com and a tasting room in Fredonia, New York. This policy explains what personal information we collect, why we collect it, who we share it with, and the choices you have. It applies to our website, our online store, our wine club, our text message program, and our tasting room.

We sell alcohol. By law we can only do business with people who are 21 or older, which shapes much of what follows.

1. Information we collect

Information you give us

  • Contact details — name, billing and shipping address, email address, and phone number.
  • Order information — what you bought, when, delivery preferences, and gift messages.
  • Wine club details — membership tier, shipment preferences, and varietal choices.
  • Age confirmation — your date of birth, entered at our age gate.
  • Communications — messages you send us by email, web form, or text.

Information collected automatically

  • Device and usage data — IP address, browser type, pages viewed, and referring site.
  • Cookies and similar technologies — described in section 6 and in our Cookie Policy.

Payment information

Card payments are processed by Stripe. Your full card number is transmitted directly to Stripe and is never stored on our servers. We receive only a confirmation, the card brand, and the last four digits.

2. Age verification

Before you can browse or purchase, our website asks for your full date of birth. We use it once, in your browser, to calculate whether you are 21 or older.

We do not transmit or store your date of birth from the age gate. If you are old enough, your browser saves a small local marker so you are not asked again for 30 days. That marker records only that verification succeeded — not the date you entered.

Separately, some deliveries require an adult 21 or older to show identification and sign at the door. That check is performed by the delivery carrier, not by us.

3. How we use your information

  • To process, fulfill, and deliver your orders, and to handle returns.
  • To manage wine club memberships and recurring shipments.
  • To send order confirmations, receipts, and shipping and tracking updates.
  • To send promotional offers and winery news, where you have opted in.
  • To confirm you are of legal drinking age and to comply with alcohol beverage laws.
  • To answer questions and provide customer service.
  • To understand how our site is used so we can improve it.
  • To detect and prevent fraud, and to meet our legal and tax obligations.

4. Text messages and mobile information

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors performing services on our behalf, such as customer service providers or shipping carriers, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

We do not sell, rent, or lease mobile phone numbers or SMS consent records to anyone, and we never provide them to advertising platforms for audience targeting. This applies to current subscribers, former subscribers, and anyone who has expressed interest in our messaging program.

You are only added to our text program if you affirmatively opt in — by checking an unchecked box on our website or at checkout, or by signing a printed form in our tasting room. Consent to receive marketing texts is never a condition of purchase.

Message frequency varies, and is approximately four messages per month. Message and data rates may apply. Reply STOP to any message to unsubscribe, or HELP for assistance. You can also reach us at 1-716-679-9463.

5. How we share your information

We do not sell your personal information for money. We share it only as described here.

Service providers

Companies that perform work on our behalf and may only use the information to do that work:

  • Stripe — payment processing.
  • UPS — delivery and adult-signature verification.
  • Odoo — our website, online store, and customer records platform.
  • Our SMS provider — delivery of text messages you have opted into.

Advertising partners

We advertise on Meta (Facebook and Instagram) and Google. To reach people likely to enjoy our wines, we sometimes provide these platforms with a list of customer email addresses, which they match against their own users. Email addresses are transmitted in hashed form.

We do not include mobile phone numbers or SMS subscriber information in these lists.

Under California law this practice is considered "sharing" personal information for cross-context behavioral advertising. See section 8 for how to opt out.

Legal and safety

We may disclose information where required by law, subpoena, or regulation, including alcohol beverage control and tax reporting; to enforce our terms; or to protect the rights, property, or safety of Woodbury, our customers, or others.

Business transfers

If the winery is sold or merged, customer information may transfer as part of that transaction. Mobile opt-in data and SMS consent records are excluded from any such transfer for marketing purposes.

6. Cookies and tracking

We use cookies and similar technologies to keep you signed in, remember your cart, remember that you passed the age gate, and understand how the site is used.

We currently use:

  • Google Analytics (via Google Tag Manager) — site traffic and usage measurement.
  • Meta Pixel — measures the performance of our Facebook and Instagram advertising and allows us to show ads to people who have visited our site.

Most browsers let you refuse or delete cookies. Blocking them may break your cart or sign-in. More detail is in our Cookie Policy.

We honor Global Privacy Control (GPC) signals as a valid opt-out request from browsers that send them.

7. Your choices

  • Email — click unsubscribe in any marketing email, or contact us.
  • Text messages — reply STOP to any message.
  • Advertising — opt out of interest-based ads through your Meta and Google account settings, or ask us to remove you from our advertising lists using the contact details below.
  • Account information — sign in to review and update your details, or ask us to do it for you.

We will always send transactional messages about an order you placed, even if you have opted out of marketing.

8. California privacy rights

If you are a California resident, you may have the right to:

  • Know what personal information we collect, use, and share about you.
  • Request a copy of that information.
  • Request deletion of your information, subject to legal record-keeping we are required to maintain for alcohol sales.
  • Correct inaccurate information.
  • Opt out of the sharing of your personal information for cross-context behavioral advertising.
  • Not be discriminated against for exercising these rights.

To opt out of sharing for advertising, email admin@woodburyvineyards.com with the subject line "Do Not Share My Personal Information," or call 1-716-679-9463. You may also send a browser GPC signal, which we honor automatically.

To make any other request, contact us using the details in section 12. We will verify your identity by matching the information you provide against our records, and will respond within 45 days. An authorized agent may submit a request on your behalf with written proof of authorization.

9. How long we keep information

We keep order and transaction records for as long as required by New York alcohol beverage and tax law, and generally no less than seven years. Marketing contact details are kept until you opt out. Wine club records are kept for the life of the membership plus any period required by law. Age gate verification markers expire after 30 days.

10. Security

We use industry-standard safeguards including encrypted connections and a payment processor that keeps card data off our systems. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

11. Children

Our website and products are intended solely for adults 21 and older. We do not knowingly collect personal information from anyone under 21. If we learn that we have, we will delete it. If you believe a minor has given us information, contact us immediately.

13. Changes to this policy

We may update this policy from time to time. The effective date at the top will change when we do. If we make a material change to how we handle your information, we will provide additional notice. Continued use of our website after an update means you accept the revised policy.
